Buford man will not serve time in prison for U.S. Capitol riot charge

A man from Buford will not serve time in prison in connection to his involvement in the U.S. Capitol riot on Jan. 6, 2021, following his sentencing on Thursday.

According to The Atlanta Journal-Constitution, U.S. District Court Judge Dabney Friedrick sentenced Verden Andrew Nalley, 50, to two years probation, community service and a $500 fine.

Nalley's defense attorney claimed Nalley had been influenced by the mentality of those participating in the riots when he entered the U.S. Capitol for about 40 minutes. 

Prosecutors reportedly asked Nalley to be sentenced to 14 days in prison per his guilty plea to a misdemeanor charge. Prosecutors said comments Nalley made on social media in the weeks following the riot showed no remorse for his actions. The AJC said court records show Nalley posted on social media that he would return to the U.S. Capitol with guns if the election results were not "fixed."

Defense attorney Gregory Hawker noted Nalley had almost no criminal record aside from a misdemeanor marijuana charge when he was 18. 

Nalley reportedly went to Washington with William McCall Calhoun, Jr. Calhoun is an attorney in Americus. The two men played in a band together.

Calhoun also faces charges connected to the riot.
