Baldwin, Habersham County negotiate over 145-acre annexation

In separate meetings Monday, the Baldwin City Council and Habersham County Commission could decide whether the county will allow Baldwin to annex roughly 145 acres on Thompson Road for development.

In June, the Habersham County Commission voted to object to Baldwin’s annexation of the property zoned for less than 50 homes, where a developer proposed building 730 residential units and a shopping strip.

That triggered arbitration between the parties. A hearing had been planned for Thursday morning, but was cancelled late Wednesday afternoon.

“A tentative agreement in the Habersham County v. City of Baldwin: Thompson Road arbitration has been reached,” the Habersham County cancellation notice reads. “The hearing is suspended pending approval of the agreement by the Habersham County Board of Commissioners and the Mayor and City Council of Baldwin.”

Lula Capital LLC has purchased the land, in the vicinity of Thompson Road and Wilbanks Road behind Dairy Queen on Ga. 365 and announced plans to develop it as follows:

  • 10 acres for commercial with at least five businesses,
  • 20 acres for multi-family residential,
  • 32.5 acres for single-family residential,
  • 43.5 acres for single-family detached residential, and
  • 39 acres for single-family detached residential.

The proposed development would increase traffic on the already stressed stretch of Ga. 365 from Ga. 384 (Duncan Bridge Road) to Ga. 52 (Lula Road in Hall County) by 28%.

The Habersham County Commission will discuss the matter in both its work session at 4 p.m. and its regular meeting at 6 p.m. Monday in the Jury Assembly Room of the Habersham County Courthouse, 295 Llewellyn Street, Clarkesville.

One resident of the affected area already has signed up to speak on the issue during Monday night’s county commission meeting.

The Baldwin meeting to discuss an intergovernmental agreement with Habersham County, Lula Capital LLC and Rochelles 2010 LLC will take place at 6:30 p.m. at the Baldwin Municipal Courtroom, 155 Willingham Avenue, Baldwin.
