Marsh attorney wants a new judge

LAFAYETTE - The lawyer for Tri-State Crematory operator Ray Brent Marsh wants to replace the Cobb County judge who agreed to hear the case after local judges stepped aside. <br> <br> The 28-year-old Marsh is charged with 204 felony counts of theft by deception. <br> <br> The four Superior Court judges in the Lookout Mountain Judicial District disqualified themselves, citing personal ties to the case. That&#39;s when Judge James G. Bodiford of Cobb County was appointed. <br> <br> Defense attorney Ken Poston filed a motion yesterday saying that Marsh was concerned with Bodiford&#39;s ``feelings of obligation toward the &#39;community&#39; of Walker County.&#39;&#39; <br> <br> In an affidavit made public Monday, Judge Kristina Cook Connelly of Summerville, one of the four who had recused themselves, questioned Bodiford&#39;s ability to handle the case fairly because he volunteered to take the case as a favor to Judge Jon Bolling Wood.
