Marsh attorney wants a new judge

LAFAYETTE - The lawyer for Tri-State Crematory operator Ray Brent Marsh wants to replace the Cobb County judge who agreed to hear the case after local judges stepped aside. <br>

The 28-year-old Marsh is charged with 204 felony counts of theft by deception. <br>
<br>
The four Superior Court judges in the Lookout Mountain Judicial District disqualified themselves, citing personal ties to the case. That's when Judge James G. Bodiford of Cobb County was appointed. <br>
<br>
Defense attorney Ken Poston filed a motion yesterday saying that Marsh was concerned with Bodiford's ``feelings of obligation toward the 'community' of Walker County.'' <br>
<br>
In an affidavit made public Monday, Judge Kristina Cook Connelly of Summerville, one of the four who had recused themselves, questioned Bodiford's ability to handle the case fairly because he volunteered to take the case as a favor to Judge Jon Bolling Wood.
