Witnesses testify about shooting of grandmother's ex-boyfriend

<p>When a security guard tried to coax Lena Driskell out of her ex-boyfriend's apartment after she arrived uninvited, Driskell refused to leave, telling the guard she had something for him.</p><p>Moments later, she pointed a pistol at his left temple and fired, Theresa Barnes testified Thursday as Fulton County prosecutors began laying out their case against Driskell, 79, who is accused of fatally shooting 85-year-old Herman Winslow after their yearlong relationship soured.</p><p>Driskell faces charges of murder, aggravated assault and possession of a firearm during the commission of a felony. Prosecutors are not seeking the death penalty.</p><p>Barnes said she had been working at the Hightower Manor apartments in southwest Atlanta for six months when Winslow came to her the night of June 10, 2005, about two hours before the end of her shift. Winslow wanted Driskell removed from his apartment. Driskell had a key to Winslow's first-floor unit and let herself in.</p><p>Barnes testified that after she sat Winslow down in the lobby to wait, she confronted Driskell and told her she had to leave. Driskell demanded the key she said Winslow also had to her apartment.</p><p>"She kept saying, 'I have something for him. Where is he?'" Barnes told jurors.</p><p>Driskell stood with her right hand behind her back and her left hand clutching her purse, Barnes testified. As she shooed Driskell out of the apartment, Barnes said the old woman stumbled onto her. She joked that the contact was "assault."</p><p>Driskell responded, "I'm not scared to go to jail. Call the police," Barnes said.</p><p>Thinking she had finally calmed Driskell down, Barnes testified she headed toward the elevator to escort Driskell to her second-floor apartment. When she turned her back, Driskell headed for Winslow, still seated on a couch in the lobby.</p><p>"She took her hand from behind her back in a sweeping motion and pointed her hand toward his left temple," Barnes said, adding later that she did not see a gun at the time. "I thought she was about to slap him."</p><p>Then, the guard said she heard a gunshot.</p><p>"I didn't think the gun was real," Barnes said.</p><p>Barnes said she grabbed Driskell, who had shot Winslow twice. At the end of the scuffle, he lay dead on the couch and Barnes said Driskell then pointed the gun at her. She ran to a nearby apartment to call 911.</p><p>When Barnes returned, she said Driskell was brandishing the pistol in the lobby, saying, "Yes, I did it. I did it. I ain't goin' nowhere."</p><p>Police arrived, eventually got Driskell to put down the pistol and she was arrested.</p>
