Georgia authorities exhume body of Sullivan uncle in Mass.

<p>The body of the uncle of a millionaire businessman charged with killing his wife was exhumed from a Massachusetts cemetery on Tuesday and reburied a few hours later after investigators took tissue samples, a prosecutor said.</p><p>Testing on the samples taken from the body of Frank Bienert, which was exhumed from a Braintree, Mass. cemetery, will be conducted over the next several weeks, said Bibb County District Attorney Howard Simms, who requested the exhumation.</p><p>"The exhumation has been done and he has been reinterred," Simms said.</p><p>Simms has said a recent review of medical records and witness interviews suggest that foul play may have been involved in Bienert's Jan. 10, 1975 death. He declined to elaborate on Tuesday.</p><p>Georgia's chief medical examiner, Dr. Kris Sperry, will oversee the testing. The results may not be known for several weeks, said John Bankhead, a spokesman for the Georgia Bureau of Investigation.</p><p>In December, Simms said he had been asked by Fulton County District Attorney Paul Howard, who is currently prosecuting James Sullivan on murder charges, to look into the death of Bienert, who was Sullivan's uncle.</p><p>Bienert, a Boston native, was originally thought to have died of a heart attack and no official investigation followed. He left Sullivan his liquor distributorship in Macon after his death. Sullivan later sold Crown Beverages Inc. for $5 million.</p><p>Simms has said Howard told him there is new suspicion that the 65-year-old Bienert may have been poisoned. Simms has not said what, if any, new evidence authorities have.</p><p>Asked in the past whether Sullivan would be considered a suspect if authorities determine Bienert was killed, Simms has said, "I would think he would be someone we'd be interested in, among others."</p><p>A lawyer for Sullivan, Don Samuel, has said that any suggestion that Sullivan killed Bienert is "ridiculous."</p><p>Sullivan, now 63, is awaiting trial on charges in the Jan. 16, 1987, death of his wife, Lita Sullivan. The 35-year-old woman was fatally shot after opening the door to her Atlanta townhouse to a gunman carrying a box of pink roses. Prosecutors have suggested Sullivan paid a hitman to kill his wife because he feared losing money and a Florida mansion in their divorce.</p><p>Sullivan fled the country around the time of his 1998 indictment on state murder, aggravated assault and burglary charges. He was arrested in Thailand on July 1, 2002, and returned to Atlanta last March after lengthy extradition proceedings. Fulton County prosecutors are seeking the death penalty against Sullivan.</p>
