NOBLE - It looks as if Cobb County Superior Court Judge James Bodiford will president over the case involving the operator of the Tri-State Crematory. <br>

The Georgia Supreme Court has refused to hear Brent Marsh's request for a different judge in his case. <br>
<br>
An aide to Bodiford -- Rob Anglin -- said Wednesday that his office was notified of the court's refusal to hear Marsh's appeal. Anglin says Bodiford will set a hearing soon to consider Marsh's request for bond. <br>
<br>
Marsh's attorney -- Ken Poston -- says that despite the unfavorable decision he is ready to move forward with the request for bond. <br>
<br>
The 29-year-old Marsh is charged with 316 counts of theft by deception. He also has been charged with 65 counts of abuse of a body. <br>
<br>
He has been in jail in Walker County since February 17, accused of taking money for cremations he never performed. <br>
<br>
Poston contended that Bodiford's impartiality was questionable because the judge publicly stated admiration for the senior judge for the Lookout Mountain Judicial Circuit that has jurisdiction in Marsh's case.
