Catoosa sheriff threatens criminal charges for leaked tape

RINGGOLD - The Catoosa County sheriff has enlisted federal help in figuring out how a tape of a May arrest ended up on national television. <br>

Sheriff Phil Summers said Friday he is asking the FBI and state investigators to find the person who leaked a videotape of a violent arrest to Fox News Channel's ``The O'Reilly Factor.'' <br>

The Georgia Bureau of Investigation already is investigating the May 31 arrest of Shane Rogers, who was punched several times by two deputies after a police chase. <br>
<br>
Summers said there were only three copies of the tape and said criminal charges could be filed against the person who gave it out. The video aired July 18. <br>
<br>
``My main concern is not only violation of departmental policy, but if the evidence in a criminal case is tampered with, it's a criminal violation as well,'' he said. ``We have conducted an internal investigation and have no direct proof on anybody or anything.'' <br>
<br>
Summers said Rogers, 30, led police on a chase that started in Chattanooga and reached speeds of up to 110 mph. Authorities in Tennessee had said he was a possible carjacking suspect, Summers said. <br>

A videocamera on the patrol car dashboard recorded the vehicle striking Rogers and knocking him to the ground. Rogers can be seen sitting up in the glare of the patrol car headlights when Sheriff's Deputy Jimmy Stockard jumped on him. <br>

The tape shows Stockard throwing at least 10 punches. Whitfield County Sheriff's Deputy Chad Stafford then rushes in swinging his nightstick at Rogers. <br>
<br>
Rogers has been in the hospital since his arrest. He was charged with driving under the influence and driving with a suspended license, attempting to elude police and speeding.
