Judge to decide whether driver will face criminal charges

By
BENTON, Tenn. - A Tennessee judge will decide by the end of the week whether a school bus driver will face criminal charges in an accident on the Georgia-Tennessee line that killed three children.

Defense attorney Conrad Finnell asked Judge Steve Bebb on Monday to reconsider Rhonda Cloer's request for pretrial diversion.

Cloer, 35, drove a Murray County school bus that collided with a train just across the Tennessee line near Tennga on March 28, 2000, killing three children and injuring four others, including her daughter.

Finnell previously filed for pretrial diversion that would have given Cloer two years of probation. The district attorney's office has denied the request.

District Attorney Jerry Estes of Polk County, Tenn. has upheld the decision so Finnell appealed to the judge.

The judge said he will read Finnell's motion and rule by Friday.
