The man accused of allowing alleged Apalachee High School shooter Colt Gray access to the gun used in the attacks is now looking to have his trial held outside of Barrow County.
Colin Gray's attorneys, Brian Hobbs and Jimmy Dodd Berry, filed the motion in Barrow County Superior Court on Sunday. The motion claims that, due to the case's prominence, Colin Gray cannot be tried fairly in the county.
"Every major newspaper in the area of Atlanta, Georgia, and surrounding counties have published and circulated newspaper articles describing the acts with which (Gray) is charged...similar publicity was broadcasted over the radio and television in the Atlanta, Georgia, and the surrounding areas," the motion said. "To try (Gray) in Barrow County, where the community feeling is strongly set against him, will violate his right to a fair trial by an impartial jury."
Gray is facing dozens of charges including second-degree murder, involuntary manslaughter, second-degree cruelty to children and reckless conduct. His son, Colt Gray, is accused of shooting and killing four people and injuring nine others in the September 4 attack at the school.
Superior Court Judge Nicholas Primm has not yet responded to the request to move the trial.
