Jefferson man arrested in Habersham County following November fatal wreck

A Jefferson man was arrested in Habersham County Monday afternoon on outstanding warrants related to a November 2022 fatal wreck in Franklin County.

Robby Douglas McDaniel, 57, of Jefferson, was arrested on an outstanding warrant for vehicular homicide for the Nov. 1 wreck at the intersection of Grady School Road and Stone Bridge Road. According to the Georgia State Patrol, McDaniel allegedly failed to stop at a stop sign, leading to that wreck which led to the death of Johnny Burton Freeman, 78, of Toccoa. 

Rob Moore, public information officer with the Habersham County Sheriff's Office, said emergency personnel were working an accident scene Monday afternoon on Ga 365 at Level Grove Road when a white semi-truck drove by the scene. Deputies said the driver of the truck, who was later identified as McDaniel, allegedly pulled out his cell phone and took a photo or video of the wreck while the semi-truck he was driving was in motion.

A Habersham County Deputy pulled over the truck after spotting the man using his cell phone while behind the wheel. The deputy ran McDaniel's license, which returned with the warrant out of Franklin County related to the November wreck. McDaniel was then arrested.

The tractor-trailer McDaniel was driving, loaded with a piece of heavy equipment, was impounded.

Franklin County Sheriff Steve Thomas said Tuesday afternoon his deputy had picked up McDaniel to be returned to that county to answer the charge.
