Fulton DA won't be allowed to question Jones

A Fulton County Judge on Monday disqualified District Attorney Fani Willis from questioning State Sen. Burt Jones in her office's ongoing probe into efforts by former President Donald Trump to overturn Georgia's election results. 

Jones, the Republican nominee for Lt. Governor, argued in court that Willis should be barred from questioning him because she recently hosted a fundraiser for his Democratic opponent Charlie Bailey. 

"This scenario creates a plain -- and actual and untenable -- conflict," Fulton County Superior Court Judge Robert McBurney said. "Any decision the District Attorney makes about Senator Jones in connection with the grand jury investigation is necessarily infected by it." 

According to the Attorney General's office, the Prosecuting Attorney's Council of Georgia will select another District Attorney's Office to question Jones. 

The Atlanta Journal-Constitution described the decision as a "significant rebuke of the DA." 

In a statement, Sen. Jones called the ruling "a huge win for our campaign --but more importantly, for due process and the rule of law in Georgia." 

Judge McBurney denied a similar effort from 11 of the other so-called 'alternate electors.' 

"There has been no showing that the District Attorney or any member of her prosecution team is impaired by a conflict of interest," McBurney wrote.
