Isakson will not vote to confirm Kagan to Supreme Court

ATLANTA - Sen. Johnny Isakson says that after interviewing Elena Kagan and following her testimony in Congress, he will vote against confirming the solicitor general to the U.S. Supreme Court.

The Georgia Republican says he supports a qualified judge who will rule ``based on the law, and who will not legislate through activist judicial decisions.'' He says Kagan's record has not met that standard.

Isakson says he also voted against Kagan's confirmation as solicitor general in 2009 because of her support of a ban on military recruiters at Harvard University and her lack of appellate trial experience.

Kagan's confirmation is widely viewed as a certainty, barring an unexpected decision by Republicans to try and prevent a final vote. The Judiciary Committee is scheduled to vote on the appointment on July 13.
