Judge speeds up a Texas rental ban case

DALLAS - A federal judge in Texas has agreed to fast-track a lawsuit challenging an ordinance in a Dallas suburb that would essentially keep illegal immigrants from renting homes there.

Earlier this month, Judge Jane Boyle issued a temporary restraining order blocking enforcement of the Farmers Branch ordinance. She's agreed to a late October deadline for motions in the case.

The ordinance would require would-be renters to get a license. Information from the application would be sent on to the federal government for verification of legal immigration status. Anyone who turns out to be an illegal would have their renter's license revoked. And any landlord who continued to rent to them would be penalized.

A number of property managers, a former Farmers Branch city council member and two civil rights groups say the ordinance is unconstitutional and infringes upon the federal government's responsibility for enforcing immigration law.
