Man pleads guilty to role in death of 2-year-old

<p>One of four suspects has pleaded guilty to reduced charges for his role in a shooting in which a 2-year-old boy was killed over an income tax refund check.</p><p>Kearndric David Smith pleaded guilty to conspiring to commit the armed robbery that resulted in the death of Xavier Miranda.</p><p>In a plea hearing last week, the Clayton County District Attorney recommended that Smith be sentenced to 10 years commuted to the 18 months he already has served with more than nine years of probation.</p><p>Smith's plea deal was made in exchange for his testimony against the other three suspects.</p><p>Torrin Reese, Michael Anthony Hendrix and Shakeila Danuaralle Hampton have been charged with murder, burglary, kidnapping, aggravated assault and attempted armed robbery in the boy's death.</p><p>The boy was fatally shot Feb. 10, 2005, when an intruder burst into his family's apartment and demanded a $1,717 income tax refund check. Clayton County police say the shooter was carrying out a plot masterminded by Hampton, who prepared the family's taxes.</p><p>During the robbery attempt, police say Reese grabbed Xavier and pointed a gun at his neck, threatening to shoot unless he got the check. But the boy's father, William Miranda, also was armed and fired shots at Reese, police said. Reese said he fired back but did not mean to hit the toddler.
