ATLANTA - Tuesday attorneys for Lynn Turner, 34, Cumming, who is charged in the death of her husband in Cobb County in 1995, suffered a loss with the Georgia Supreme Court.
The court decision was by unanimous vote.
Defense attorneys had asked the evidence in the investigation of the death of Forsyth County firefighter Randy Thompson, 32, in 2001, to which Turner has two children, NOT be heard in the trial for the death of Cobb County Police officer Glenn Turner, 31, Marietta.
Autopsies showed that both men died of antifreeze poisoning.
Agents for the Georgia Bureau of Investigation named Lynn Turner as a suspect in the death of Randy Thompson during pre-trial hearings.
Attorneys have argued that because Lynn Turner has not been charged in Forsyth County for the Thompson death, the investigative evidence should not be heard.
Prosecutors argue that because the deaths are so similar evidence cannot be ignored.
In July Cobb County Superior Court Judge James Bodiford ruled in favor of the prosecution saying indeed the cases were very similar.
Both men were found covered in blankets and wearing only shorts. The deaths were initially ruled to be caused by an irregular heartbeat but later determined to be homicide caused by ingestion of antifreeze.
Prosecutors have said Glenn Turner changed his $100,000 life-insurance policy to list his wife as his beneficiary after earlier listing a sibling, and Lynn Turner received about $50,000 in county death benefits when her husband died.
A clear motive for Thompson's death has not been established.
