Graham in Hall County jail again

GAINESVILLE - A Hall County teenager acquitted of a drive by shooting, is once again in the Hall County Detention Center.

Charles Douglas Graham, 17, McEver Extension, Gainesville was arrested in late September for fighting.

"It stemmed from an altercation that originated at Gainesville High School, and eventually later on that day, it spilled over to the Melrose Apartments area," said Gainesville Police Lt. Jeff Harris at the time of the September arrest.

"I don't know of a clear motive that actually started it, no."

Graham was charged with three counts of battery and one of violating the Georgia Gang Act for the alleged fights with two juveniles September 17.

The task force also arrested Javier Torres , 17, Gainesville on a charge of battery for allegedly helping Graham.

Hall County Sheriff's Lt. David Spillers says Graham was arrested again Monday.

"He violated the terms and conditions that are part of that bond order." Spillers says. "An arrest warrant was issued for him and he is incarcerated as a result."

This is the second time Graham has been arrested since being acquitted of murder in June.

Graham was the only suspect found NOT-GUILTY in the Smallwood Road drive by shooting that happened in July 2002.

The Hall County Sheriff's Office could not confirm what condition of bond Graham is accused of violating.
