Judge acquitted of DUI charges

By
SAVANNAH - A former juvenile court judge was found innocent of driving under the influence Friday.

Judge Juan Ayala, who stepped down from the juvenile court bench after the incident, was charged with two counts of DUI stemming from an Oct. 20 fender-bender in which his black Ford Mustang was rear-ended.

One DUI charge was dismissed because Ayala wasn't immediately read a statement of his implied consent to take intoxication tests. Ayala wasn't read his implied consent for 22 minutes, and Georgia law says it must be read at the time of the arrest.

A breathalyzer test showed Ayala's blood alcohol content was 0.104 grams above the limit of 0.08.

On the second charge, Bulloch County State Court Judge Gary Mikell determined there wasn't enough evidence that the alcohol impaired Ayala's driving.

Mikell heard the case after Chatham County judges recused themselves.
