ATLANTA - A federal appeals court has upheld the death sentence of Carl Isaacs, convicted as the ringleader of the 1973 Alday family murders in Seminole County.
Isaac's lawyer, Jack Martin, said he would appeal Tuesday's ruling by the 11th U.S. Circuit Court of Appeals to the U.S. Supreme Court.
Isaacs, 48, was convicted of the slayings in 1974, but the Atlanta appeals court granted him a new trial on grounds that pretrial publicity and community outrage prevented Isaacs and his co-defendants from getting a fair trial.
He was convicted again and sentenced to die after a 1988 trial in Houston County Superior Court. George Dungee and Wayne Coleman had their sentences reduced to life in prison.
The Aldays were farmers. Five men were shot to death as they arrived home for lunch during a burglary. Mary Alday, the wife of one of the victims, was raped and killed later.
