Prosecutor: 90-year-old killed burglar in self-defense

AUGUSTA - A 90-year-old retired doctor who fatally shot an intruder was acting in self-defense and will not be charged, District Attorney Danny Craig said Thursday. <br>

Gilbert L. Klemann shot George Thurman Epperly, 42, late Wednesday just after the burglar pushed him down inside the home, police said. <br>

``Dr. Klemann was well within his rights under the law in using deadly force to kill the burglar,'' Craig said. ``The case will not be presented to a grand jury.'' <br>
<br>
Epperly, a convicted felon, had done odd jobs around the doctor's house in recent years. He went there Wednesday night and told him he needed to pick up some tools. Sgt. Scott Peebles of the Richmond County sheriff's office said Klemann left the house, and when he returned he found Epperly ransacking his bedroom.
