Prosecutor: 90-year-old killed burglar in self-defense

AUGUSTA - A 90-year-old retired doctor who fatally shot an intruder was acting in self-defense and will not be charged, District Attorney Danny Craig said Thursday. <br> <br> Gilbert L. Klemann shot George Thurman Epperly, 42, late Wednesday just after the burglar pushed him down inside the home, police said. <br> <br> ``Dr. Klemann was well within his rights under the law in using deadly force to kill the burglar,&#39;&#39; Craig said. ``The case will not be presented to a grand jury.&#39;&#39; <br> <br> Epperly, a convicted felon, had done odd jobs around the doctor&#39;s house in recent years. He went there Wednesday night and told him he needed to pick up some tools. Sgt. Scott Peebles of the Richmond County sheriff&#39;s office said Klemann left the house, and when he returned he found Epperly ransacking his bedroom.
