CAMDEN - A jury voted to recommend life in prison without parole for a fugitive convicted of killing a convenience store customer and stealing his car. <br>

Herlan O'Brien Davis, 23, had been convicted of killing Bruce Cunningham, 39, who had stopped by the store to buy bacon for his aunt on March 9, 2001. <br>

Davis shot Cunningham at point blank range with a .380-caliber pistol, took the victim's car and picked up his girlfriend, Angela Shantee Anderson. The two headed south on Alabama 41, stopping when the car ran off the road and caught fire. <br>

Investigators said Davis and Anderson, 22, fled Columbus, Ga., after he became a suspect in a killing there. Police in Columbus said weapons charges, probation violations and a murder charge were still pending against Davis. <br>

Davis also is charged with killing Wallace Lee Smith Jr. when Smith stopped to help the couple he believed to be stranded motorists. Anderson and Davis were captured that day as they hid in a creek in northern Monroe County. <br>

Davis faces capital murder charges in Monroe County for Smith's killing on May 13. Anderson also has been charged with capital murder in Smith's death, but her trial date has not been set. <br>
<br>
Seven members of the jury voted on Thursday for a life sentence with no parole. The other five voted for the death sentence. The recommendation is not binding on Circuit Judge Jack Meigs, who will make the final decision on May 22.
