DECATUR - Former DeKalb County Deputy Patrick Cuffy goes back to court Monday as he seeks to get out of jail in exchange for testimony against former Sheriff Sidney Dorsey. <br>

Judge Robert Mallis will decide if Cuffy can enter a plea agreement on charges against him in the murder of Jeffrey ``Nigel'' George. The plea would allow Cuffy to plead guilty to evidence tampering and be released from jail. <br>

Cuffy was initially charged with murder but prosecutors downgraded it to aggravated assault in exchange for a guilty plea. But Cuffy withdrew his plea when another man was sentenced to life plus ten years in the drug dealer's slaying. <br>

In exchange for immunity, Cuffy has told police he was one of four men who went to Sheriff-elect Derwin Brown's house the night he was gunned down in his driveway in December 2000. He said they were acting on Dorsey's instructions. <br>

George was killed in a March 18 shootout in front of Cuffy's home.
