Girlfriend says law enforcement 'overreacted' when arresting Flowery Branch man

Saying that Hall County Sheriff's Office (HCSO) deputies "unnecessarily overreacted to this non-violent situation," the girlfriend of a Flowery Branch man arrested in a domestic incident has asked that her side, and that of her boyfriend, be heard. 

Marjorie Jorgensen wrote an email to various news outlets in Atlanta and North Georgia, including AccessWDUN, saying that the deputies who came to the home on Samoa Way on Wednesday, Sept. 26 came there at her request after she and her boyfriend David Umphreyville, Sr. had an argument.

"David and I had a non-violent disagreement during the course of which he locked me out of our house. I called the Sheriffs Department to assist me in getting some of my personal belongings out of the house so I could leave for the evening and let David settle down," Jorgensen said in the email. 

Jorgensen said she told the deputies Umphreyville had no weapons and was not a threat, although he was agitated; she said deputies assured her they would not arrest him.

"Although they repeatedly said they were not there to arrest him, they had guns drawn and aimed at him while he was [on] our back porch ranting and raving. When the Sergeant arrived he asked if I had keys to the house - I told him I did.  At that point he took my keys and they entered our home, guns drawn all without a search warrant," Jorgensen wrote. 

Jorgensen disputed a press release issued by the Hall County Sheriff's Office, stating that Umphreyville tossed a large piece of exercise equipment at them from a loft area.

"As for the rowing machine threat -- according to David, he had picked up the rowing machine and was going to throw it in front of the front door to block entry but upon seeing that the officers were already making entry into our home he immediately dropped the rowing machine on the ground in front of him," Jorgensen wrote. " It was never intended as a weapon or threat against them."

Umphreyville faces a dozen different charges in the incident, according to the Hall County Sheriff's Office. 

Jorgensen called the press release issued by the HCSO "inflammatory." 

In a separate email to AccessWDUN, Jorgensen emphasized that Umphreyville did not threaten her prior to her call to officers.
