Father arrested at Cumming Costco after mask dispute escalates

A viral video that surfaced on the social media platform TikTok this week shows a father being arrested outside of the Costco in Cumming after a dispute escalated with store management over the father’s son removing his mask.

Cory Wayland was detained by City of Cumming Police for refusing to show identification during the incident. He was charged with disorderly conduct then released shortly after in the parking lot of the store.

In a report from CBS46, 18-year-old Andrew Wayland, Cory’s son, is seen in the video stating, “So I just took my mask off in Costco because I need to breathe a little bit right…and manager [expletive] comes up and says I’m calling the cops because you’re not wearing a mask.” 

The Costco store policy, effective November 16, is that all shoppers and employees must wear a mask while in the store. Store members with medical conditions who cannot wear a mask must wear a face shield.

A police report included in the CBS46 article from the City of Cumming states that the teenager was asked multiple times by employees to wear a mask and that he and his father argued with employees before a manager asked the pair to leave.

Police said that they spoke to all parties upon arrival and asked for identification from Wayland’s father, who refused. Cory Wayland said that he did not have to show identification unless he was under arrest, at which point police detained him.

After Wayland was released, he and his son were both given a warning by police about trespassing at the store and barred from shopping there.

City of Cumming Police Chief David Marsh confirmed that the above information is accurate and did not have anything else to add.

Andrew Wayland said in another video posted to TikTok that he and his father plan to sue the manager of the store and the City of Cumming Police Department.

A representative from the Costco in Cumming declined comment.
