GSP: No charges in E. Hall ice cream truck accident

GAINESVILLE - No charges will be filed after a little boy was struck by a vehicle passing an ice cream truck earlier this week in the East Hall area.
 
The Georgia State Patrol confirmed that Wednesday. Troopers said a red Dodge Magnum went to pass a marked ice cream truck parked facing south in the southbound lane of Floyd Road.
 
The Dodge struck a child that ran out from behind the ice cream truck.
 
The driver of the ice cream truck was identified as 19-year-old Maria Mendoza and her passenger as 27-year-old Alamaraz Perez-Zeferino; the driver of the Dodge was identified as 26-year-old Monterio Pierce.
 
The only person injured, seven year old Victor Borilla, was air-lifted to Scottish Rite.
 
According to the police report, all three were warned: Pierce for improper passing, Borilla/his parent for failure to yield, and Mendoza and Perez-Zerefino for an unspecified concern.
