King's Hawaiian takes discount grocery chain to court over packaging

GAINESVILLE — King's Hawaiian Bakery has filed a lawsuit against Aldi, claiming the discount grocery store chain is purposely trying to confuse customers with the packaging of its off brand rolls.

King's Hawaiian Bakery Southeast, Inc. - which is based in Oakwood - filed the lawsuit in federal court in Gainesville on Wednesday, October 21, according to a report in the Atlanta Business Chronicle. 

The suit claims Aldi is trying to rip off the packaging of King's Hawaiian Original Hawaiian Sweet Rolls, thus confusing consumers. King's Hawaiian attorneys write in the lawsuit that the color of the product packaging and wording on the package could lead customers to believe that King's Hawaiian and Aldi are affiliated in some way or that King's Hawaiian endorses Aldi's product.

The federal lawsuit asks for unspecified damages. It also seeks a jury trial in federal court.
