Another challenge to White Co. septic waste operation

CLEVELAND - The legal wrangling over the permitting of a septic waste disposal operation in White County continues.

It all began in 2008 with the application by Chris Mote Pumping Service of Cleveland for the facility. After a lengthy process, which include a well attended public hearings at the White County Courthouse, the Georgia Environmental Protection Division issued a permit for the business in March of 2010.

Since then, residents in the Paradise Valley Road area have been working to stop the business from getting underway. They petitioned the court to overturn the permit and received a favorable ruling but that was overturned last year.

Petitioners were back in White County Superior Court Friday asking visiting Senior Superior Court Judge Stephen Boswell to overturn an administrative law judges decision last November clearing the way for the operation. The citizens were represented by property owner and attorney Van Stephens and Senior Assistant Attorney General Bill Phillips represented the state.

In a one hour court presentation both sides presented their case and Judge Boswell then ask each side to present transcripts of their evidence for review.

The judge did not indicate when he would make a ruling.

Chris Mote attended the proceeding Friday and declined comment but indicated he wanted to see this process over.
