GAINESVILLE - A preliminary hearing has been set for the Gainesville man accused of killing a West Hall man during a home invasion last week.

Donald Poland, who was arrested Saturday night, appeared in Hall County Magistrate's Court Monday afternoon for a first appearance hearing, where the charges facing him were formally outlined.

Poland is accused of killing Max Baggett, 69, during a burglary at Bagget's home on Monroe Road.

He was arrested in Gwinnett County Saturday night following a police chase.

The preliminary hearing, at which a judge will determine whether to send the case to a Grand Jury, will be held May 23.
