Jackson County has issued a response to Vulcan Materials Company’s petition for review after the Jackson County Board of Commissioners voted to deny their proposed rock quarry.
The response was filed on Thursday after Vulcan’s initial petition on Dec. 2.
The petition by Vulcan earlier this month stated that the 5-1 decision by the commission was “not sustained by sufficient evidence.”
In their response by Monroe-based attorney Charles Ferguson, who represents Jackson County, they state that the board’s decision to deny the special use applications was “abundantly supported by the evidence in the record before the board…”
The response also states that the decision was in accordance with Jackson County code, Georgia law, and other applicable law.
“The Board’s decision … is presumptively valid and constitutional,” the filing said. “Petitioner Vulcan has failed to rebut said presumptions.”
