Hall authorities: no charges in truck vs bicycle wreck that killed child

Authorities say the driver of the pickup truck that hit a bicycle carrying two children in Gainesville last week will not face charges.

Hall County Sheriff's Office officials made the announcement Monday morning, almost a week after the crash that ultimately resulted in the death of Carlos Herrera Espinal, age 10. Another child, age 7, was also on the bicycle at the time of the accident, but survived.

Hall County Schools officials confirmed Friday that one of the two children hit by a pickup truck while riding a bicycle in Gainesville Tuesday evening has died.

Hall County Schools Spokesman Stan Lewis said Carlos Herrera Espinal, age 10, passed away this week. He was one of the two children injured in the Tuesday evening crash on Green Hill Circle.

Lewis said Herrera was a student at Lyman Hall Elementary School near Gainesville.

"The district is heartbroken over the passing of Carlos Herrera. Our thoughts and prayers go out to the family, Lyman Hall Elementary School, and the community," Lewis said in a statement. "Student services will have an emergency crisis team at the school on Monday to assist school counselors and social workers with any student or staff member struggling with this tragic loss. The Lyman Hall community is strong, and we will pull through this difficult time together."

The Hall County Sheriff's Office said Friday afternoon that no charges have been filed in the case so far with the case still under investigation.

Two children were seriously injured in a collision between a pickup truck and a bicycle Tuesday night in Gainesville.

Hall County Sheriff’s Office Deputies were called to the scene on Green Hill Circle just before 6:55 p.m.  When authorities arrived, they found the two male juveniles, ages 10 and seven, with serious injuries. Both were taken to a local hospital for treatment. The 10-year-old was airlifted to Children's Healthcare of Atlanta.

A preliminary investigation of the collision determined the boys were riding together on one bicycle on Shallowford Rd. traveling in the Direction of Green Hill Circle. The bicycle entered the intersection of the two roadways and struck the side of the truck. Both children were ejected from the bicycle. 

The driver of the truck remained at the scene of the accident, according to HCSO. The boys’ conditions are unknown as of last report.
