A Forsyth County man was killed while mowing his grass Wednesday afternoon. A car ran off the road at Hopewell Road near Church Road, running over Paul Nix, 68 of Cumming.

The Forsyth County Sheriff’s Office says that the accident happened around 4 p.m. and Nix was declared dead at the scene of the accident. The driver of the car has been identified as Kenneth Johnson, 22.

While investigating the scene, a cell phone was found in the debris on the ground outside of the Ford Fusion Johnson was driving. A text screen was visible and it appears Johnson was texting while he was driving. A field sobriety test also determined Johnson was under the influence.

Johnson was arrested and charged with homicide by vehicle 1st degree, driving under the influence, reckless driving, too fast for conditions, failure to maintain lane, and writing sending reading texts while driving.

Johnson was taken to the Forsyth County Jail and is being held without bond.
