Gwinnett Police investigating pedestrian struck, killed by car in Buford

A Lawrenceville man was killed while attempting to cross Buford Drive Tuesday night.

Gwinnett Police identified the man as Benjamin Phenix, 35, in a press release Wednesday. They believe Phenix was crossing the road from Braves Drive around 10 p.m. when he was hit by a car.

"The vehicle traveling on Buford Drive did have the right of way," said Corporal Colin Flynn with Gwinnett County Police.

Phenix died from his injuries at the scene.

It's unclear if Phenix was in a crosswalk or not, Flynn said, but they did know a little more about the driver's actions. "The driver of the vehicle that hit Mr. Phenix did stop, and the driver is cooperative with police," Flynn said. He said there were no charges filed on the scene and investigators would release information on whether or not any charges would be filed after the investigation was complete.
