Roswell resident struck, killed by vehicle on Ga. 59 near Commerce

A Franklin County driver will not face charges in the death of a pedestrian on Ga. 59 in Banks County Tuesday night.

Andrew Kelly, 28, of Carnesville was driving a 2008 Ford Focus south on Ga. 59 when a pedestrian entered the road from the eastbound shoulder, according to Cpl. Joshua Hedden of Georgia State Patrol Post 6 in Gainesville.

That pedestrian, Katarzyna Stapor, 39, of Roswell was fatally injured upon being struck by the right front bumper of Kelly’s car in the southbound travel lane of Ga. 59, Hedden said.

The pedestrian was not in a crosswalk and was not wearing reflective clothing, Hedden said, adding no charges will be filed.
