A Homer man was sentenced Monday to 20 years and must pay Banks County nearly $445,000 in restitution for theft of county services that occurred from 2016-2018.
Anthony Eugene Sullivan, 58, was charged by indictment in 2019 for three counts of theft of services, and he was sentenced through a blind plea on Jan. 6, Banks County court documents show.
A blind plea is a guilty plea without a set sentence, meaning the sentencing is left to the discretion of the judge.
Sullivan must serve eight years in prison, then can serve the balance of the three 20-year concurrent sentences on probation.
According to state records, Sullivan serves as chief executive officer, chief financial officer and corporate secretary for Tony’s Water Service Inc. in Homer, a Georgia for-profit corporation formed on Sept. 11, 2012.
Under Count 1, Sullivan allegedly dumped wastewater at the Banks County water treatment facilities, which was available only by compensation to the county, between Jan. 1 and Dec. 31, 2016.
Count 2 covered 2017, while County 3 covered the period Jan. 1 through Sept. 1, 2018.
Sullivan was booked in at the Banks County Law Enforcement Center on Jan. 6.
