GSP charges driver in Banks County wreck that claimed life of toddler, seriously injured child Saturday afternoon

A Toccoa man faces felony vehicular homicide and DUI charges after a three-vehicle wreck that claimed the life of a 3-year-old on Interstate 85 near Banks Crossing Saturday afternoon.

Charles Raymond Evans, 56, of Toccoa will be charged with felony vehicular homicide, felony serious injury by vehicle, driving under the influence, reckless driving, following too closely, and expired tag, according to Cpl. M.D. Patterson of Georgia State Patrol Post 6 in Gainesville.

The wreck happened about 2:52 p.m. on I-85 northbound near mile marker 149.

A 2010 Toyota Corolla driven by 37-year-old Cristina Chiles of Woodstock and a 2017 Honda Accord driven by 42-year-old Lashonda Montgomery of Conyers were traveling north on I-85 in the left lane near the 149.5 mile marker, according to Patterson. Montgomery’s Honda was stopped in the traffic backup resulting from a prior fatal crash that occurred at mile marker 153. Chiles’ Toyota Corolla was stopped behind Montgomery’s Honda Accord.

Evans’ 2017 Dodge Ram 1500 was traveling north on I-85 in the left lane overtaking the two cars, failed to stop and struck the rear of the Toyota, causing it to travel off the left shoulder of the roadway into the median, according to Patterson. The truck then continued northbound in the left lane and struck the rear of the Honda, where both came to rest.
Evans, who suffered non-life-threatening injuries, was transported by GSP to Northridge Medical Center in Commerce.

Chiles suffered non-life-threatening injuries and was transported to Piedmont Athens Regional Hospital by Banks County Emergency Medical Services.

A 3-year-old passenger in Chiles’ car suffered a fatal injury, and a 7-year-old passenger in her car suffered a serious injury and was transported to Piedmont Athens Regional Hospital by Banks County EMS, according to Patterson.

Montgomery suffered non-life-threatening injuries and was transported to Piedmont Athens Regional Hospital by Banks County EMS.

Montgomery’s passenger, 43-year-old Calvin Robinson of Conyers, suffered non-life-threatening injuries and was transported to Piedmont Athens Regional Hospital by Banks County EMS, Patterson said. 

The Georgia State Patrol Specialized Crash Reconstruction Team (SCRT) is assisting in the investigation.
