Former State Rep. Dan Gasaway and his attorneys will be in court Monday, Jan. 28, arguing that the House District 28 race in North Georgia was carried out incorrectly - not just once, but twice.
Gasaway's current lawsuit, filed Dec. 19, 2018, also claims the Banks County Sheriff and his family voted out of district in the race, a claim Sheriff Carlton Speed has denied.
Republican Gasaway lost the primary election in May 2018 to Republican challenger Chris Erwin. There were admitted errors in the way Habersham County elections officials distributed ballots in the primary, so a special election was held to determine the outcome of the race.
Erwin won the election by just two votes, an outcome confirmed after a recount.
Erwin has already been sworn in to office and is serving in the House of Representatives.
The lawsuit is being heard in Banks County Superior Court.
