A shooting in Stephens County early Sunday left one man dead and another jailed.

The incident happened about 12:15 a.m. Sunday at 11 Patrick Lane, Toccoa.

Richard Gary Hiott, 41, of 11 Patrick Lane, died at the scene, said Stephens County Sheriff Randy Shirley Tuesday night.

Shirley identified the suspect as Gary Lamar Patrick, 73, of 184 Patrick Lane, Toccoa.

"The suspect, Mr. Patrick had previously been at the residence and confronted the sister of the victim," Shirley said via text. "An argument ensued but Patrick left. Mr. Patrick came back again and began arguing with the homeowner."

That's when things escalated.

"The victim, who was the brother of the homeowner, stepped in between them in an attempt to stop Mr. Patrick from arguing with her, who appeared to be intoxicated according to the homeowner," Shirley said. "The victim was subsequently shot by Mr. Patrick in the chest area. He died at the scene."

Shirley called in state authorities to assist his personnel.

"I requested the GBI to assist our investigators in the investigation," Shirley said. "The gun was recovered from the suspect, Mr. Patrick. The suspect remained at the scene and was taken into custody after deputies did initial interviews."

Patrick is charged with one count of murder. He is being held without bond in the Stephens County Jail.

Hiott's body was taken to the GBI Crime Lab in Decatur by the Stephens County Coroner's Office for an autopsy.
