ATLANTA - In its third order in just one day, the Supreme Court of Georgia (SCOGA) dismissed the State’s appeal of a number of rulings by the Athens-Clarke County Superior Court in the death penalty case of Jamie Hood.
Hood is accused in the 20-11 killing of Athens police officer Elmer "Buddy" Christian.
In its first order, the high court issued a temporary stay halting the trial.
In its second order, the court denied another motion and lifted the temporary stay, ordering the clerk of the Athens court to immediately transmit that notice of appeal to the Supreme Court.
The Supreme Court has now received the notice of appeal and considered it, leading to a third order, dismissing the State’s appeal.
Bottom line: the trial court has regained full authority to proceed with Hood’s trial.
