ATLANTA (AP) Home Depot is asking a judge to dismiss a federal lawsuit filed by consumers after a massive data breach last year.
The nation's biggest home improvement retailer says in court documents this week that the consumers haven't been economically injured. Home Depot says most of the plaintiffs were fully reimbursed and did not identify any ``deceptive act.''
Consumers have said the company should have done more to prevent breaches.
The Atlanta-based retailer has said that hackers initially accessed its network in April 2014. The breach affecting 56 million debit and credit cards was disclosed in September.
A U.S. District Court judge split complaints related to the breach into two categories consumers and financial institutions. The company has not yet responded in the financial institutions' complaint.
