Sabrina Graham also asked the state Supreme Court to find constitutional a new state law that prohibits the release of certain information about executions, including the source of the drug.
A lawyer for death row inmate Warren Lee Hill argued Fulton County Superior Court Judge Gail Tusan had the power to stay his client's execution and said the law isn't constitutional.
Oral arguments in the case came on Monday.
Hill's lawyers say the process surrounding executions must be transparent. State attorneys say the law is constitutional and necessary to discourage retaliation against those who take part in executions.
