According to the Atlanta Journal Constitution, Christopher Proescher, who works at a Cumming gun shop, got into an argument with a private security guard for Gary Pirkle Park in Sugar Hill on April 20 when the guard told him he could not exercise at the park wearing his gun in a holster.
Proescher told the newspaper he had researched the city ordinance and determined that carrying the weapon in the park was legal.
The security guard called two Gwinnett police officers to help him when the argument escalated, according to the newspaper.
Ultimately, Proescher was arrested and charged with suspicion of criminal trespassing. He was freed on bond later the same day.
None of those named in the lawsuit has commented.
