Gwinnett judge to hear argument in library case

GAINESVILLE - A Gwinnett County judge will hear arguments in an attempt to keep a Hall County judge from hearing a suit filed by Clermont against the Hall County Commission over the North Hall library.

Chief Superior Court Judge C. Andrew Fuller was assigned to hear the suit when it was filed in the spring. But, Clermont filed a motion seeking to remove Fuller from the case. The other Hall County judges recused themselves from hearing the motion to remove Judge Fuller.

Reggie Forrester, Court Administrator for the Northeastern Judicial Circuit, says the matter was then sent to Michael Clark, Administrative Judge for the Ninth Judicial Administrative District, for "judge assignment."

Clark says, in an order filed with the Hall County Court Clerk's Office, that Gwinnett Superior Court Judge Debra K. Turner has agreed to preside over the matter.

No date for a hearing has been set.
