Gwinnett Co. challenging charter school law

ATLANTA - Seven public school districts, including Gwinnett County Schools, are battling the state in court over whether Georgia's charter school laws are constitutional.

During a hearing Friday morning in Fulton County Superior Court, the districts argued that the Georgia Charter Schools Commission is illegal and should not be allowed to take their state funding away and give it to charter schools. The state says the charter schools law is legally sound.

The school districts suing the state are: Gwinnett County, Atlanta, DeKalb County, Bulloch County, Candler County, Henry County and Griffin-Spalding County.

The lawsuit poses the first legal challenge to a controversial 2008 law establishing the independent commission.

Both sides are asking Judge Wendy Shoob to rule on the case to prevent it from going to trial.
