In a letter sent to Gov. Sonny Perdue on Wednesday, Thurbert Baker said a state lawsuit ``is likely to fail and will consume significant amounts of taxpayers' hard-earned money.''
On Tuesday, attorneys general in 13 states filed a lawsuit seeking to overturn the massive health overhaul bill, arguing it is unconstitutional. Perdue has asked Baker to sue, saying the law will wreak havoc on the state's finances.
State Rep. Tim Bearden, a Villa Rica Republican, was also circulating a bill in the House urging Baker to sue.
Baker is seeking the Democratic nomination for governor.
