Ga. school districts ask justices to toss ruling

ATLANTA - Seven public school districts say the Georgia Charter Schools Commisssion is unconstitutional and is illegally taking money from their coffers.

During arguments before the Georgia Supreme Court on Tuesday, attorneys for the districts asked the justices to overturn a May ruling by a Fulton County Superior Court judge.

State attorneys argued that the commission is within its rights to take money from the districts because it's state funding. The districts say the money is actually local dollars that belong to them.

The justices are expected to rule in coming weeks. It's the first ever legal challenge to the state's charter school law.

The districts in the lawsuit are among the state's largest Gwinnett County, DeKalb County and Atlanta Public Schools as well as smaller districts like Bulloch, Henry, Candler and Griffin-Spalding schools.
