Defense attys challenge sex offender's sentence

ATLANTA - Defense attorneys are challenging the 30-year minimum mandatory sentence for those convicted of aggravated child sexual abuse.

The case before the 11th Circuit Court of Appeals Wednesday has generated criticism from Republican House lawmakers who said in an amicus brief that a ruling in favor of defendant Kelly Farley would ``abridge Congress' authority to impose punishment'' that it deems appropriate.

The case also tests a key tenant of the federal Adam Walsh Act which threatens stiff penalties to crack down on sex offenders. Prosecutors say the three-judge panel's ruling will likely set a significant precedent throughout the country.
