City to appeal ruling in Times' suit

GAINESVILLE - The Gainesville City Council voted today to appeal a judge's ruling handed down against the city last week in a suit filed by The Times.

The ruling ordered the city to make available to the newspaper an unedited version of a sexual harassment complaint filed against then-city manager Bryan Shuler... complete with the names of the people who filed the complaint.

The vote to appeal was 3-2. Councilmen George Wangemann and Bob Hamrick voting "no."

Sam Harben is one of the attorneys handling the case for the city.

"The city believes that this will still be an invasion of their privacy since they were completely innocent of anything," said Harben.

He said the ruling is also a deterrent to the enforcement of the city's harassment policy.

The attorney for The Times, Steve Gilliam, said the law will back up the previous ruling despite the city council's decision to appeal.

"We feel that the law is pretty clear on it and there are exceptions in the Open Records Act and what we're asking for here there is not an exception for," said Gilliam.

The matter now goes to the state Court of Appeals.
