The Atlanta Journal Constitution reported Tuesday that the man tapped by Governor Perdue to lead the appeal has stepped down because of a potential conflict of interest.
Former U.S. Solicitor General Paul Clement is leaving the position because he was once "attorney of record" for the U.S. Army Corps of Engineers - another party in the case.
The AJC reports that he's been replaced by Seth Waxman, another former U.S. Solicitor General.
