Lula, Buford, Clayton fined by EPD

ATLANTA - Towns in Hall, Gwinnett and Rabun counties have been hit with fines by the state Environmental Protection Division (EPD).

There are three of them: Lula, Buford and Clayton.

Buford and Clayton are each being fined $5,000 for sewage spills.

Lula is being fined $1,000 for violations in the operation of its wastewater treatment pond.

Lula City Manager Dennis Bergin said in 2004 the EPD changed the amount of pollutants that the city can discharge, prompting them to begin the application process to build a new waste treatment plant.

Bergin said he is "understanding" of the EPD's fine, and that it came about because "the drought situation and the current existing conditions don't allow for enough dilution to take place."

Bergin said the pollutants are on a very small scale, and that there is a solution. "We're building a new waste treatment plant that's state-of-the-art and will eliminate the problem."

However, the plant won't be finished right away. "Until we finish the completion of the plant it could continue to be a problem," Bergin said, adding that Lula does want to abide by the EPD's rules.

Buford City Manager Bryan Kerlin couldn't be reached for comment on Wednesday.
