Tim Madison, chief prosecutor in the Piedmont Judicial Circuit for 24 years, resigned in July during an investigation by the state attorney general's office and the Georgia Bureau of Investigation.
Superior Court Judge Robert Mallis also ordered Madison to serve six years' probation and to pay $40,000 in restitution.
Madison, who headed prosecutions in Banks, Barrow and Jackson counties, pleaded guilty to felony theft, violation of oath of office, making false statements and writings and conspiracy.
He was indicted in August along with his wife, former victim-witness coordinator Linn Madison, and former assistant district attorney Brett Williams.
State prosecutors said the DA and Williams schemed to bill Banks County more than $50,000 for a full-time salary for Williams, and splitting the money. At the time, Williams was already getting his full state-paid salary as an assistant DA.
Charges against Madison and his wife involve the time sheets that Linn Madison submitted to Banks County, even though she allegedly was out of town at the time, according to the state attorney general's office.
The charges still are pending against Linn Madison and Williams.
